Force Majeure

W&WN shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, earthquakes, hurricanes, wildfires, floods, war, terrorism, riots, embargoes, fires, accidents, pandemics, disease, strikes, or other similar disasters. Also, in such an event, the cancellation policies described in Section 2.3 may not apply and W&WN may, in its reasonable discretion, issue refunds under terms that vary from the Cancellation policy.Recipient initial

Limitation of Liability

W&WN has no liability for any claims, injuries, loss, harm and/or damages arising from, and/or in any way related to, acts or omissions by Client or third parties, the behavior of your pet(s), or your failure to vaccinate your pet(s). Rates, Fees, & Payments

4.1 Rates Rates for Services are billed at a half-hourly, hourly, or daily rate—as requested by the Client. Current rates can be found on the W&WN website, when requesting a date and time for Services, or by contacting a W&WN representative directly.
4.2 Last Minute Booking Fee A Last Minute Booking Fee of $15 will be added to any Reservation made less than 24 hours before the requested date and time for Services. This fee may be waived or refunded at the discretion of W&WN.
4.3 Holiday Fee A Holiday Fee of $25 will be charged on all reservations where Services are rendered on the following holidays: holidays. Holiday Fees are non-refundable.
4.4 Cancellation Fee A Cancellation Fee of $20 will be deducted from any refund made in conjunction with our Cancellation policy (section 2.3).
4.5 Unplanned Expenses Client is responsible for all Unplanned Expenses related to the emergency care of their pet including, but not limited to: veterinary care, transportation, and kenneling/boarding.
4.6 Payment W&WN accepts the following forms of payment: credit card and e-payments made through CashApp. Payment must be made prior to rendering Services.
4.7 Refunds Refunds, minus any applicable fees, will be made via the payment method used to pay for Services. ONCE ANY “SERVICE” HAS BEEN RENDERED DURING A RESERVATION, THERE WILL BE NO REFUNDS FOR ANY REQUESTED “SERVICES” FOR THE REMAINDER OF THE RESERVATION.Recipient initial

Indemnity

TO THE MAXIMUM EXTENT PERMITTED UNDER ANY APPLICABLE LAW AND EXCEPT AS OTHERWISE PROHIBITED BY APPLICABLE LAW, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD W&WN HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, EXPENSES, DAMAGES AND/OR LIABILITIES, INCLUDING REASONABLE ATTORNEYS’ FEES AND COURT COSTS, THAT ARE IN ANY WAY RELATED TO: (1) your breach of these Terms; (2) your misstatements, misrepresentations, or violation of applicable law; (3) property damage or personal injury to third parties caused by your pet(s) or other pets in your home; (4) loss, injury, or death of your pet while in your own home. YOU FURTHER AGREE THAT YOU WILL COOPERATE WITH US IN THE DEFENSE OF SUCH CLAIMS. Right of Refusal

3. Right of Refusal
W&WN reserves the right to refuse to provide Services at any time for any reason. If Services cannot be provided because W&WN determines upon arrival at the Client’s home that the Client’s pet or home environment poses a danger to health or safety and/or concerns or situations prohibit W&WN from caring for pet, then unrendered Services will be non-refundable.Recipient initial

Scheduling & Cancelation

2. Scheduling and Cancellation
2.1 Requests Requests made by Client, whether through the W&WN website, text/SMS, or email, for specific Services dates/times are not guaranteed.
2.2 Reservations Requested Services dates/times where payment has been made in advance and the dates/times have been confirmed by W&WN shall be deemed a Reservation.
2.3 Cancellation of a Reservation must be confirmed by W&WN. Any Cancellation of a Reservation more than 24 hours in advance of the reserved date/time is subject to a Cancellation Fee (section 4.4) and any applicable Holiday Fee (section 4.3). Cancellation of a Reservation 24 hours, or less, in advance of the reserved date/time will not be subject to any refund.Recipient initial

Veterinary Care & Records

Client must provide contact information where they can be reached in the event medical care for a pet becomes necessary. W&WN agrees to immediately contact the Client in the event such care becomes necessary. Client hereby authorizes W&WN to obtain and authorize the provision of veterinary care for your pet if you cannot be reached to authorize care yourself in an emergency situation. In such case, you also authorize your pet’s veterinarian(s) to release your pet’s veterinary records to W&WN. You release W&WN for any injury, damage or liability arising from the provision of emergency care or the failure to seek such care pursuant to this section. CLIENT IS RESPONSIBLE FOR THE COSTS OF ANY SUCH MEDICAL TREATMENT FOR PETS AND YOU HEREBY AUTHORIZE W&WN TO CHARGE YOUR CREDIT CARD OR OTHER PAYMENT METHOD FOR SUCH COSTS. It is recommended that all Clients have adequate pet insurance to cover the costs of veterinary care.

Severability

If any clause or provision of the Terms is held to be illegal, invalid, or unenforceable, it will be so held to the minimum extent required by law, and all other clauses and provisions of the Terms will remain valid and enforceable.
